These Terms of Service (“Terms”) govern your access to and use of services provided by Spectrum Stream Pty Ltd (trading as Aussie Pen Test) (“we”, “our”, “us”) via aussiepentest.com.au. By engaging our services or using our website, you agree to these Terms.
1. Services
We provide cybersecurity services including penetration testing, automated security assessments, and white-label security services. The specific scope, deliverables, and timelines for professional engagements are set out in a separate Statement of Work (SOW) or engagement letter agreed upon before work commences.
2. Authorisation and Legal Use
By engaging our penetration testing or security assessment services, you warrant that:
- You are the owner of, or have explicit written authorisation to test, the systems, networks, and applications in scope
- The engagement will not violate any applicable laws, including the Criminal Code Act 1995 (Cth) and state-based cybercrime legislation
- All information provided to us about the target environment is accurate
We reserve the right to immediately suspend or terminate any engagement if we have reason to believe the above warranties are not met.
3. Automated Security Assessments
Our automated security assessment product scans publicly reachable infrastructure associated with the domain or IP range you provide. By purchasing this service you confirm that you own or are authorised to scan the specified target. Assessments are delivered as informational reports and do not constitute professional legal or compliance advice.
4. Payment
Automated assessment fees are charged at the time of purchase via Stripe. Professional engagement fees are invoiced per the terms in your SOW. All prices are in Australian dollars (AUD) and include GST where applicable.
Refunds for automated assessments are available within 24 hours of purchase if the report has not yet been delivered. Once delivered, all sales are final. For professional engagements, refund terms are set out in the applicable SOW.
5. Confidentiality
We treat all client information and engagement findings as strictly confidential. We will not disclose your information or assessment results to any third party except as required by law or as set out in our Privacy Policy. We expect clients to treat any tools, techniques, or non-public information shared by us during an engagement with equivalent care.
6. Intellectual Property
Reports and deliverables produced for you as part of an engagement are yours to use for your internal security and compliance purposes. Our underlying methodologies, tools, and templates remain our intellectual property.
7. Limitation of Liability
To the maximum extent permitted by Australian law, our total liability for any claim arising from or related to our services is limited to the amount paid by you for the relevant service. We are not liable for any indirect, incidental, or consequential loss including loss of data, revenue, or business opportunity.
Security testing carries inherent risk. While we take all reasonable precautions to minimise disruption, you acknowledge that testing may occasionally cause temporary service interruption. Specific risk mitigation measures are agreed in advance via the SOW.
8. Disclaimers
Our reports reflect findings at a point in time based on the agreed scope. They do not guarantee that your systems are free from all vulnerabilities. Security landscapes change rapidly — we recommend regular re-testing.
9. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
10. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of our services after changes constitutes your acceptance of the updated Terms.
